GENERAL TERMS AND CONDITIONS
1. Scope of Application
The following General Terms and Conditions (GTC) apply to all orders placed via our website. The offer on this website is directed exclusively at consumers residing in Switzerland (hereinafter referred to as “customer”).
A consumer is considered to be any natural person maintaining business relationships with Sanilu GmbH that cannot be attributed to either their commercial or independent professional activity. Orders in non-household quantities may be refused without justification.
Sanilu GmbH reserves the right to amend these GTC at any time. The version applicable at the time of the order shall apply, and may not be unilaterally changed for that order. Any terms and conditions of the customer that conflict with or deviate from these GTC will not be recognized.
The operator of this website is Sanilu GmbH.
2. Information on this Website
Sanilu GmbH provides information about products and services. Price and assortment changes as well as technical modifications are reserved. All information on this website (product descriptions, images, illustrations, videos, dimensions, weights, technical specifications, accessory relationships, and other details) is provided for illustration purposes, is approximate, and is non-binding. In particular, they do not represent assurances of characteristics or guarantees, unless explicitly stated otherwise. Sanilu GmbH endeavors to provide all information and data correctly, completely, up to date, and clearly, but cannot provide any express or implied warranties.
All offers on this website are non-binding and do not constitute a binding offer.
Sanilu GmbH cannot guarantee that the products listed will be available at the time of ordering. Therefore, all information on availability and delivery times is without guarantee and may change at any time without notice.
3. Prices
The sales prices listed by Sanilu GmbH are final prices and include statutory VAT and any other statutory charges, such as advance recycling fees (ARF) or copyright levies on electronic devices, unless otherwise noted. Prices are quoted net in Swiss Francs (CHF).
Any shipping costs, unless otherwise provided, are charged separately and must be paid by the customer. Shipping costs are shown separately during the ordering process.
Technical changes, errors, and misprints are reserved. In particular, Sanilu GmbH may change prices at any time and without notice. Sales prices do not include consulting and support services.
4. Conclusion of Contract
The products and prices on this website are considered non-binding offers.
By placing an order via this website, including acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. Sanilu GmbH then sends an automatic order confirmation by email, which confirms receipt of the customer’s offer. Orders placed are binding on the customer. Unless otherwise stated, there is no right of return or withdrawal.
The contract is concluded as soon as Sanilu GmbH sends an acceptance confirmation by email, confirming shipment of the ordered products or services.
Orders are only shipped after full payment has been received (exception: delivery on account) and provided the goods are available. If it transpires that the ordered goods cannot be delivered in whole or in part, Sanilu GmbH is entitled to accept or fulfill the order only in part. In such cases, Sanilu GmbH will inform the customer by email. If payment has already been received, it will be refunded to the customer. If no payment has yet been made, the customer will be released from the payment obligation.
5. Payment Options and Retention of Title
The following payment options are available to the customer, as indicated during the ordering process:
-
PayPal:
Payment via the online payment service PayPal with your email address and a password. Your order is protected by PayPal’s buyer protection. As we receive immediate payment confirmation, the order is usually processed more quickly. -
Purchase on Account / Installment Purchase (MF Group / POWERPAY):
We offer the option of ordering on account, in cooperation with MF Group / POWERPAY. After selecting this payment method, MF Group automatically checks address details and creditworthiness. If the order is not confirmed, we recommend choosing another payment method.
The invoice is usually sent by email a few minutes after the order. Payment term: 20 days from the order date. Installment payment is possible (at least 10% of the invoice amount per month). Invoices must be paid exclusively to MF Group. The GTC of MF Group apply. By choosing this payment method, we assign the corresponding claim to MF Group.
For invoice inquiries, please contact MF Group AG directly (billing@mfgroup.ch / Tel. 058 806 06 02). -
Credit Card:
We accept common credit cards such as Visa and Mastercard. The charge is made by your card-issuing institution in accordance with their terms. -
TWINT:
Payment via the TWINT app. The invoice amount is charged directly to the linked account or credit card. Simply scan the QR code or enter the payment code. More info: www.twint.ch. -
PostFinance:
Payment via PostFinance Card or PostFinance E-Finance. From an amount of CHF 700.–, entry of a PIN and use of a card reader is required. The amount is debited directly from the account.
Sanilu GmbH reserves the right to exclude customers from certain payment options without giving reasons or to insist on advance payment. In the event of late payment, default interest of 5% p.a. as well as reminder fees of up to CHF 20.– per reminder may be charged.
The delivered products remain the property of Sanilu GmbH until full payment has been received.
6. Delivery, Duty to Inspect, Notification of Defects, and Returns
Deliveries are made by post or courier to the address provided by the customer in the order.
Sanilu GmbH endeavors to meet the shortest possible delivery times. However, any delivery times stated in the order confirmation are non-binding. Sanilu GmbH is entitled to make partial deliveries; in such cases, shipping costs are charged only once.
The invoice, if delivery on account is offered, will be sent at Sanilu GmbH’s discretion by email or by post.
If delivery is undeliverable or the customer refuses to accept it, Sanilu GmbH may terminate the contract after notifying the customer by email and setting a reasonable grace period, and charge the customer for any costs incurred.
The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects covered by Sanilu GmbH’s warranty promptly in writing by letter or email to the address stated in the imprint.
Returns to Sanilu GmbH are at the customer’s expense and risk. Goods must be returned in their original packaging, complete with all accessories, along with the delivery note and a detailed description of the defects, to the return address indicated by Sanilu GmbH in the imprint.
If Sanilu GmbH’s inspection reveals that the goods have no defects or that they are not covered by the manufacturer’s warranty, Sanilu GmbH may charge the customer for costs incurred, including return shipping or disposal.
7. Right of Withdrawal
The customer is granted a right of withdrawal for 30 calendar days after receipt of the goods. The deadline is met if the customer sends the written withdrawal by email or letter (address as per imprint) to Sanilu GmbH within the deadline. No justification is required for the withdrawal.
Exercising the right of withdrawal results in the cancellation of the contract. The customer must return the goods within 30 calendar days, in their original packaging, complete with all accessories, along with the delivery note, to the return address indicated by Sanilu GmbH in the imprint. Returns are at the customer’s expense and risk. Any payment already made will be refunded within 20 calendar days, provided Sanilu GmbH has already received the goods or the customer can provide proof of shipment.
Sanilu GmbH reserves the right to claim reasonable compensation for damage, excessive wear, or loss of value due to improper handling, and to deduct the reduction in value from the purchase price already paid or to invoice the customer accordingly.
No right of withdrawal is granted in the following cases:
- If the contract involves an element of chance, particularly because the price is subject to fluctuations beyond the supplier’s control.
- If the contract concerns a movable item that, due to its nature, cannot be returned or may deteriorate quickly.
- If the contract concerns a movable item manufactured to the customer’s specifications or clearly tailored to personal needs.
- If the contract concerns digital content not provided on a tangible medium or if the contract is to be fully performed by both parties immediately.
- If the contract concerns a service and is to be fully performed by the supplier with the prior express consent of the customer before the withdrawal period expires.
- In the areas of accommodation, transport, catering, and leisure activities, where the supplier undertakes to provide services at a specific time or within a precisely defined period.
8. Warranty
Sanilu GmbH endeavors to deliver goods of flawless quality. In the event of defects reported in good time, Sanilu GmbH assumes warranty, during the statutory warranty period of usually two years from the delivery date, for the freedom from defects and functionality of the purchased item. Sanilu GmbH may choose to fulfill the warranty by free repair, replacement with an equivalent item, or refund of the purchase price. Any further warranty claims are excluded.
The warranty does not cover normal wear and tear, consequences of improper handling or damage by the customer or third parties, or defects resulting from external circumstances. The warranty is also excluded for consumable and wear parts (e.g., batteries, rechargeable batteries, etc.).
Sanilu GmbH cannot give any assurances or guarantees regarding the timeliness, completeness, and accuracy of data, or the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, no guarantee is given that the use of the website does not infringe third-party rights not owned by Sanilu GmbH.
9. Liability
Sanilu GmbH excludes any liability, regardless of legal basis, as well as any claims for damages against Sanilu GmbH and its auxiliaries. In particular, Sanilu GmbH is not liable for indirect damages, consequential damages, lost profits, or other personal, material, or pure financial losses of the customer. Mandatory statutory liability, such as for gross negligence or unlawful intent, remains reserved.
Sanilu GmbH uses hyperlinks solely to facilitate the customer’s access to other web offers. Sanilu GmbH cannot know the content of these web offers in detail, nor can it assume liability or any responsibility for the content of such websites.
10. Data Protection
Sanilu GmbH may process and use the data collected during the conclusion of the contract to fulfill obligations arising from the purchase contract and for marketing purposes. The data necessary for service performance may also be passed on to commissioned service partners (logistics partners) or other third parties.
The data protection provisions can be accessed in detail at the following link: Privacy Policy
11. Partial Invalidity
If individual provisions of these GTC are found to be invalid or unenforceable, or become invalid or unenforceable, the validity of the remaining provisions shall not be affected.
12. Final Provisions
Sanilu GmbH expressly reserves the right to change these GTC at any time and to bring them into force without notice.
In the event of disputes, only substantive Swiss law shall apply, to the exclusion of conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
