General terms and conditions

  1. Scope of application

The following GTC apply to all orders placed via our online store by consumers and entrepreneurs.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.

These General Terms and Conditions shall also apply to future business relationships with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

  1. Contractual partner, conclusion of contract

The purchase contract is concluded with Sanilu GmbH.

By placing the products in the online store, we submit a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

  1. Contract language, contract text storage

The language available for the conclusion of the contract is German.

We save the text of the contract and send you the order data and by e-mail. You can view the text of the contract in our customer login.

  1. Terms of delivery

Delivery costs of CHF 14.95 will be charged for all orders under CHF 99
From 99 CHF purchase value of selected products, shipping is free of charge.

For selected bulky goods agricultural products, bulky goods surcharges of 180 CHF may apply.
For selected bulky goods playground equipment, bulky goods surcharges of 90 CHF may apply.

We deliver by mail order. Collection by the customer is possible in 3638 Pohlern on collection notification.

  1. Payment

PayPal (free of charge):
PayPal is the online payment service that allows you to pay securely, easily and quickly in online stores. Payment is made via the PayPal website using your e-mail address and a password and is completed in just a few clicks. As we receive an immediate payment confirmation from PayPal, the item usually arrives sooner than with other payment methods. Your order is also protected by PayPal buyer protection.

Purchase on account / purchase in 10 installments (free of charge):
We offer the option of conveniently ordering your purchase on account. We offer this service in cooperation with the MF Group. When ordering on account, there areno additional costs for .

After the payment method "Invoice" has been selected, MF Group automatically checks the address data and creditworthiness.

If the order is not confirmed, we recommend selecting another payment method.

You will usually receive the invoice by e-mail 5 minutes after placing your order. You can view your outstanding invoices and payments using your POWERPAY account number, invoice number & e-mail address: www.monatsrechnung.ch

The payment period is 20 days from the order date. It is possible to pay the invoice in installments. No registration or special request is required for this. For each invoice you can pay the minimum amount of 10% or more. If you opt for flexible installments, you will receive an invoice each month with a blank payment slip and the total amount still outstanding. This allows you to set your invoice amount flexibly each month (min. 10%). You have the option of ordering up to a shopping cart limit of CHF 10,000 after a successful credit check.

Important:
Do not pay to the Sanilu GmbH account with this option. Please note that invoices are to be paid directly to MF Group. The General Terms and Conditions of MF Group apply.

Credit card (free of charge):
We accept all major credit cards such as Visa, Mastercard. The applicable fees and billing methods depend on your credit card company.

TWINT (free of charge):
With the TWINT app from your bank, you can complete payment transactions in the Sanilu online store quickly, securely and without any fees. The total amount of your purchase is then debited directly to the account or credit card that is stored with TWINT.

Paying with TWINT is that easy:

Have you finished shopping? Then select the TWINT payment option at the checkout, whereupon a QR code will be displayed.
Now start the TWINT app, select the symbol with the QR code and scan the QR code displayed in the online store with the app.*
Authorize the payment if required and that's it, you're done!

* If you are shopping via smartphone in the Sanilu online store, tap on the QR code icon in the TWINT app and then on the "Code" tab. Then all you need to do is tap in the numerical code displayed in the online store and that's it.

PostFinance (free of charge):
Paying by PostFinance Card and PostFinance e-finance is secure and fast. This is because you have the option of paying for your order directly online.
Enter your card and ID number when paying with your Post Finance Card. If your order value exceeds CHF 700 (limit per transaction and month), you will also need your personal PIN and a card reader. As soon as you have confirmed the payment, the amount will be debited directly from your account. 

  1. Retention of title

The goods shall remain our property until payment has been made in full.
For entrepreneurs, the following also applies: We reserve title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you assign to us in advance all claims arising from this resale - irrespective of any combination or mixing of the goods subject to retention of title with a new item - in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations.

  1. Warranty and guarantees

Unless expressly agreed otherwise below, the statutory liability for defects shall apply.
The following applies to the purchase of used goods by consumers: if the defect occurs after the expiry of one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.

For entrepreneurs, the limitation period for claims for defects in newly manufactured goods is one year from the transfer of risk. The sale of used goods is subject to the exclusion of any warranty. The statutory limitation periods for the right of recourse according to § 445a BGB remain unaffected.

In relation to entrepreneurs, only our own information and the manufacturer's product descriptions included in the contract shall be deemed to be an agreement on the quality of the goods; we accept no liability for public statements made by the manufacturer or other advertising statements.

If the delivered item is defective, we shall initially provide warranty to entrepreneurs at our discretion by remedying the defect (rectification) or by delivering a defect-free item (replacement delivery).
The above restrictions and shortened deadlines do not apply to claims based on damage caused by us, our legal representatives or vicarious agents

in the event of injury to life, limb or health

in the event of intentional or grossly negligent breach of duty and fraudulent intent

in the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)

within the scope of a guarantee promise, if agreed

insofar as the scope of application of the Product Liability Act is opened.

Sanilu GmbH has the right to withdraw from the contract if an item is incorrectly named or incorrectly priced in the online store. 

  1. Liability

We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents

in the event of injury to life, limb or health,

in the event of intentional or grossly negligent breach of duty,

for guarantee promises, if agreed, or

insofar as the scope of application of the Product Liability Act is opened.


In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability shall be limited to the amount of damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.


Sanilu GmbH is not liable for incorrect product descriptions, product numbers, product quantities and the accompanying images.

  1. Dispute resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/.
We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

  1. Final provisions

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.

Our installation service includes a one-off installation on site, as specified in the quotation or order. If defects occur within our one-year warranty period, we will send the relevant material to the customer for self-assembly - free of charge.

However, if you wish to make use of the guarantee service provided by a Sanilu GmbH technician, the work will be invoiced as follows: We charge an hourly rate of CHF 118 for the journey to and from the site and any congestion surcharge plus the installation time.

Example calculation: The costs for travel to and from the event amount to CHF 472 plus CHF 118 for one hour's work, making a total of CHF 590. Materials are provided free of charge in this case.
